Mr Marende has said he is prepared to give a ruling on the matter if it is raised on the floor of the House
Parliament re-opens Tuesday afternoon to a looming showdown over the controversial judicial nominations made by President Mwai Kibaki on Friday.
President Kibaki nominated Court of Appeal judge Alnashir Visram to become the new Chief Justice, Prof Githu Muigai as Attorney General, Kioko Kilukumi as Director of Public Prosecutions and William Kirwa to the position of controller of budget.
The nominations have sparked a political row with Prime Minister Raila Odinga claiming that he was not consulted as required by law.
The Judicial Service Commission and the Commission for the Implementation of the constitution have also strongly opposed the nominations terming them unconstitutional.
JSC says it was sidelined in the process of picking suitable candidates for the top judiciary jobs. Addressing journalists in Nairobi Monday at a press conference attended by Chief Justice Evan Gicheru and Attorney General Amos Wako, JSC secretary Lydia Achode petitioned the President to withdraw the nominations for a fresh start.
The President has forwarded the contentious list of nominees to House speaker Kenneth Marende.
The president made the latest  move as the PM reportedly indicate that he would stop tabling of the names in Parliament by writing to the Speaker requesting him to make a ruling on whether the names should be accepted in the absence of consultations.
Mr Marende  has said he is prepared to give a ruling on the matter if it is raised on the floor of the House.
