Kombo won polls expert tells court

An election expert called in as a witness in a case challenging the election of Moses Wetang’ula as Bungoma senator said the election was marred with massive irregularities. and was not free and fair.
 Barasa Nyukuri an election expert , researcher , statistician, and social scientist testifying in favour of Kombo who is challenging Wetang’ula's win.
 He told the court he was asked by the petitioner to carry out a forensic audit of the elections. Barasa said he used the Forms 35 and 36 provided by the IEBC and confirmed the final results were different from the one announced.
 “Your Honour, out of the 802 polling stations in the entire Bungoma county 522 had massive irregularities that could not be wished away ,’he said.
 Barasa testified that in some polling stations like Nzoia Industrial Primary in Kanduyi and Namunyiri primary the voter turnout was over 500 per cent.
 Nyukuri further told court forms 35 and 36 provided by IEBC to the agents of the petitioner were different from the ones filed in court.
“Your honour the figures and remarks by returning officers in these forms differ," he said He said Kombo won the elections.
 “ I tallied the votes in the nine constituencies using IEBC documents and Kombo got 139,639 votes and not 125,853 votes announced,”he said Nyukuri was the tenth witness to testify.
 Elsewhere a Bungoma High Court directed IEBC to bring to court ballot boxes for 10 polling stations in Kabuchai Constituency for scrutiny for alleged malpractices by the petitioner who is challenging the election of James Lusweti Mukwe as Kabuchai MP.
Philip Mukui the runners up in the election had filed an application requesting the court to order a recount of votes in 98 polling stations. The High Court Judge Lady Justice Hellen Omondi ordered a recount of votes in 10 polling stations only.
The polling stations include Namaondo Primary, Busakala Secondary School, Chwele Polytechnic and Senandiki Primary, Khachonge Primary stream A and B, Makhonge Primary, Lukhuna Market and Lukhuna Primary. respectively. Supporters of the two sides have been jamming the court rooms since the petition began.
