Businesswoman Mary Wambui is free to contest the Othaya parliamentary seat after a court struck out a petition seeking to challenge her eligibility.
High Court judge David Majanja said the court has no jurisdiction to entertain an application seeking to block a person from presenting himself or herself to the electorate.
Justice Majanja allowed a preliminary objection brought by Ms Wambui seeking to dismiss the application.
Ms Wambui is among several aspirants eyeing the Othaya seat presently held by President Kibaki, who is due to retire.
Four petitioners had moved to court seeking to block Ms Wambui's bid. Michael Nderitu, Silvester Murithii, Daniel Karinga and Kiambati Kihumba had raised integrity and education issues against the businesswoman.
The four said Ms Wambui lacked secondary education and has alleged links to the drug trade.
However, Ms Wambui, through lawyer Evans Monari, objected saying Parliament has established bodies to address issues raised by the petitioners.
"The Independent Electoral and Boundaries Commission should verify Ms Wambui's integrity and if it errs, the petitioners can challenge the decision," Mr Monari said.
