The High Court has stopped the Local Government minister, Musalia Mudavadi from degazetting 28 Orange Democratic Movement (ODM) Councillors.
The court has instead ruled the the Councillors continue serving until their case is determined.
The Councillors are said to be allied to Eldoret North MP William Ruto.
Last week, 44 councillors filed an urgent application at the High Court seeking an injunction against the minister.
They wanted the court to quash the Interim Independent Electoral Commission’s (IIEC) recommendation to revoke their positions.
However, in an earlier interview, Prof Nyong’o said ODM was acting in line with the Political Parties Act, which grants parties the right to nominate or revoke nomination of councillors.
The move is viewed as part of Prime Minister Raila Odinga’s strategy to punish rebels in ODM and reward party loyalists ahead of the grassroots elections.
