Wambui might show her school papers in August

Wednesday, July 24, 2013 - 00:00 -- BY WAMBUGU KANYI
OTHAYA MP Mary Wambui will know next month whether the High Court in Nyeri will demand her academic certificates. Justice Jairus Ngaah said on Monday he will rule on August 6 on an application filed by petitioner Peter King’ara, who is disputing Wambui’s win in the March 4 elections.
Wambui, through her lawyer Cecil Miller, opposed King’ara’s application to see certified copies of her O-Level and post-secondary school certificates and diplomas.
Miller said the law did not require that a parliamentary candidate in the last general election have a minimum level of education. The IEBC, through its lawyer Gideon Kibet, also opposed the application for academic certificates, saying it should be dismissed as incompetent.
But King’ara, through his lawyer Kyalo Mbobu, said Wambui, like most educated people, should be proud to show off her academic certificates. King’ara has filed another application seeking to have 45,000 votes cast in Othaya scrutinised and recounted.
Wambui and IEBC opposed the application. “There are not enough reasons or sufficient evidence for the court to warrant the scrutiny at this time. We are only left with submissions and judgement,” said Miller.
King’ara said more than 90 out of 112 polling stations had irregularities. He said 4,600 votes were missing. “Almost all polling stations reported errors in forms 35 and 36.
The officers involved have admitted this in court. To end this suspicion once and for all, it is better to open all the ballot boxes,” said Mbobu.
