Judiciary can try Uhuru and Ruto, says AG

The government has said it is prepared to investigate and prosecute President Uhuru and Deputy President William Ruto over the 2007-08 post-election violence if the ICC agrees to refer the cases back to Kenya.
Attorney General Githu Muigai on Monday told the Justice and Legal Affairs Committee that Kenya’s landscape has changed with the constitution promulgation on August 27 in 2010.
“The government has the capacity to investigate and prosecute the three ICC cases if referred to Kenya,” Githu said. The committee is chaired by Ainabkoi MP Samuel Chepkong’a.
Uhuru, Ruto and radio journalist Joshua Sang are facing charges of crimes against humanity at the ICC.
The committee tabled a report in the Naktional Assembly on Tuesday capturing some of the discussions it held with the AG. Chances of the cases against Uhuru, Ruto and Sang being referred to Kenya however appear remote.
Uhuru’s case is set to start on July 9 while that of Ruto is scheduled to start on September 10.
ICC is however yet to rule on Uhuru’s request that his case be postponed to next year. In May, the ICC judges dismissed a request by the African Union to have the cases against Uhuru and Ruto referred to local courts.
