Friday March 22, 2013 - There is an ongoing debate in our political circles on whether President –elect Uhuru Kenyatta and his Deputy William Ruto should enjoy state security and security briefings.
We at the Kenyan DAILY POST went ahead to peruse on whether Uhuru Kenyatta and William Ruto are supposed to enjoy State trappings from the day the Independent Electoral and Boundaries Commission (IEBC) declared them victorius.
Here is a detailed synopsis of the Powers and Privileges accorded to President elect Uhuru Kenyatta and his Deputy William Ruto by the the Constitution.
Powers and Privileges of President –elect and his Deputy
1.Security Detail: Upon the declaration of the final results of a Presidential election by the Commission under Article138 of the Constitution and Section 39 of the Elections Act (No. 24 of 2011), the Committee( formed by the incumbent President) shall ensure that the President-elect and Deputy President-elect are accorded adequate security.
2. Security Briefing: The Committee shall ensure that the President-elect under Section 9 receives security briefings from the respective national security organs.
3. Public Officers: Public officers are required to provide required information to the President –elect and his Deputy (public officers include the Prime Minister Raila Odinga and Vice President Kalonzo Musyoka)
(a) A public officer from whom information is requested under subsection and shall provide the information within a reasonable time.
(b) A public officer who fails to comply with the provisions of this section commits an offence and is liable, on conviction, to a fine not exceeding one million shillings or to imprisonment for a term not exceeding two years, or to both.
NB: Prime Minister Raila Odinga and Vice President Kalonzo Musyoka are public officers who should report to the President -elect unless they relinquish the posts.
