CIC Chair Charles Nyachae warns that this precedent does not augur well for the country
The Commission for the Implementation of the Constitution Wednesday raised concerns over the current and blatant disrespect of court orders and the general disregard for the rule of law in the country.
While revisiting the unconstitutional appointment of county commissioners, CIC Chairman Charles Nyachae cited the ongoing teachers' strike which was banned by the industrial court, as the latest in a trend of cases in which the court has been treated with contempt.
CIC has written to the Attorney General asking him to ensure the executive and parliament uphold the law.
Nyachae said this is one instance of the blatant disregard for the law, a trend that seems to have drastically seeped into the country not only at the behest of the ordinary citizens but the executive as well.
The CIC chairman also took issue with the executive's failure to appoint an Inspector General of Police as stipulated in Article 245(2).
These issues have continued to raise concern for the Constitution Implementation Commission which now warns that this precedent does not augur well for the country with the fast-approaching general election.
Chief Justice Willy Mutunga Tuesday faulted the teachers for ignoring an industrial court ruling against their strike.
