Muslim lobby groups oppose marriage Bills

Coast Muslim leaders fear that three proposed family laws could introduce the concept of pre-nuptial agreements contrary to their faith and beliefs.
Area Supkem chairman Mudhar Khitamy said the Bills, if enacted, would challenge the Chief Kadhi’s powers and the kadhi courts as the arbitrators of Islamic traditions.
“Some of what is being proposed may give rise to women-women marriages and water down the position of husbands in the family,” he said.
Islamic tenets
In their statement in Mombasa on Tuesday, the leaders asked the Justice ministry and Parliament to stop further internal review of the Marriage Bill, Matrimonial Property Bill and the Family Protection Bill.
These, according to nominated MP Sheikh Mohamed Dor, who read the statement, would go against the tenets of Islam and Muslim values, traditions and convictions.
“Islamic rights are divine rights and responsibilities for Muslims cannot and will not be compromised by Muslims,” they said.
The statement signed by 10 Muslim organisations argued that the national unity did not demand that all citizens have the same dialect or the same religious belief or other forms of conformity.
Those at the Press conference were representatives of Council of Imams and Preachers of Kenya, Supkem, Kauli, Majma Al Ahbab, Majlisulftah and the Shia IthnaAsheri Community.
