CJ, striking Kisii lawyers fail to agree

CHIEF Justice Willy Mutunga has asked members of the public, especially families, to arbitrate disputes instead of moving to court. Speaking in Kisii where he failed to resolve a three-week lawyers strike, Mutunga said arbitration is a cheap way of solving disputes. The CJ said the provincial administration, the clergy, clan elders and neighbors are in a position to solve some of the issues. "These will reduce the backlog of cases in courts and give ample time for the judgment of serious matters," the CJ said.
Mutunga failed to reach an agreement with the lawyers, who maintained that they will not call off the strike until their grievances are addressed. The lawyers, who went on strike three weeks ago, want judges Ruth Sitati and Roseline Korir to be transferred over their alleged incompetence. “Our meeting with the CJ has not yielded any fruits,” LSK South Nyanza Kisii chapter Momanyi Aunga told the press after a meeting with Mutunga at Dados Hotel. They said they are concerned by the failure of the judges to discharge their judicial duties.
The lawyers claim that the two have not been able to deliver and or render judgments and rulings in concluded cases most of which date back to July last year. “The pending rulings and judgments, some which relate to Applications filed under certificates of urgency and uncontested Ex-parte applications have hampered and or obstructed justice,” the lawyers memorandum said in part. “To fortify our complaint, we impress upon you to take cognizance of the number of pending rulings and judgments, standing in the region of 400 files,” the lawyers said.
The advocates denied reports in a local daily that they called for the strike because the two judges do not accept bribes.“We are not litigants so the report in the local daily is misleading and malicious,” Aunga said. Mutunga however assured the lawyers that he will address their concerns.
