This Ba guy of Shelter Afrique will be brought to justice


Sunday the 22nd of July 2012 - Credible information reaching the Kenyan DAILY POST indicates that the board of Shelter Afrique is set to have special sittings on Wednesday and Thursday which will aim at getting to the bottom of the controversy surrounding the organization’s Managing Director Allassane Ba who is said to have roughed up its Finance Director Karen Kandie on June 28th.

Mr Ba has become sort of a poster boy for the diplomatic immunity in the past few weeks as news  reports have focused on the fact that the police have been unable to take any action against the Mauritanian even though they have questioned him over the incident. PM Raila Odinga has even given his two cents on the matter, calling on Mauritius to lift Ba’s immunity so that appropriate action can be taken.

Kandie has said Ba assaulted her in his office when she confronted him on her end-of-year performance appraisal. Board Secretary Ruth Onyancha said on Sunday that it will decide this week on whether or not the organization’s immunity covers Ba.

Ba’s diplomatic immunity has proven to be a tricky matter. Kenya’s Foreign Affairs Ministry has contended that Ba’s immunity does not cover such criminal matters and he can thus be prosecuted. The letter addressed to Police Commissioner Mathew Iteere by Foreign Affairs PS Thuita Mwangi says that the immunity offered to the Shelter Afrique under a 1983 agreement does not grant its officials absolute protection in such matters;

“The government signed a host country agreement with Shelter Afrique on October 19, 1983. Article 31 of the agreement provides that ‘without prejudice to the privileges and immunities granted, the officials of Shelter Afrique are required to respect the laws and regulations of Kenya.’ it is therefore clearly implied that the immunities enjoyed under the host country agreement are not absolute and are indeed subject to the laws of the host country,” read the letter which was also copied to DPP Keriako Tobiko.
