Missing explosives claim in Iranian case

A second package suspected to contain RDX explosives is missing, a Nairobi court heard yesterday. Assistant commissioner of police John Mulauni told the court he does not know what happened to the second package and that no official record for recovery was ever made. The defence argued that when recoveries and arrests are made, they should be booked.
The commissioner, who was testifying against the two Iranian terror suspects, also said there were no markings done on exhibits recovered and there is nothing to show they were recovered in Mombasa. He said fingerprints that were taken from the bags have been taken to the CID headquarters but the results are still being processed.
The defence was convinced that if the fingerprints results were out, it would have been able to say with certainty who handled the package. The witness also confirmed to the court that the procedures of the police standing orders were not followed since no entry was made and no record was entered to show the exhibits were passed to Mombasa office.
On Monday, bail granted to the two suspects was suspended after the Director of Public Prosecution moved to the High Court to challenge the same Justice Lydia Achode stated that “upon reading later dated 19 July 2012 written by the Director of public prosecution, it is hereby ordered that orders of the trial court granting bail o the two suspects is hereby stayed until the application for revision is heard and determined interparties” The two had been released on a cash bail of Sh2 million each with a Kenyan surety of Sh5 million each.
