Appeal hearing on election date postponed

The petitioners are disappointed over the action by IEBC to announce the election date
The much anticipated hearing of a case filed at the Court of Appeal challenging a ruling by a three constitutional court judge bench over the election date has been postponed.
The case will now be mentioned on Tuesday next week before the presiding judge Riaga Omollo for directions.
The latest development comes as debate over the March 4th2013 election date announced by IEBC continues to divide public opinion.
The hearing of the case was postponed after Justice Phillip Waki one of the court of appeal judges presiding over the appeal was involved in other official engagements.
The case was filed by a women coalition movement opposed to the ruling of Justice Isaac Lenaola led bench that next elections be held next year, unless the two Principals agree to dissolve the coalition government in writing.
Their lawyer Stephen Mwenesi was upbeat that the ruling will be reversed.
The petitioners expressed disappointment over the action by IEBC to announce the election date while the matter is still pending at the appeals court.
In the appeal, the women want the court of appeal to issue stay orders on the implementation of the ruling as well as barring IIEBC from fixing the date of the next general election.
