Mutula gripe personal, says Uhuru ally

An ally of Deputy Prime Minister Uhuru Kenyatta has accused Justice Minister Mutula Kilonzo of holding a personal vendetta in his calls for Uhuru to resign.
Former Gatanga MP David Murathe on Wednesday said that Mr Kilonzo is asking Mr Kenyatta to resign as deputy prime minister because he believe the former Finance Minister is behind a move by Kenya Revenue Authority to recover up to Sh350 million from his salary as MP.
Mr Murathe further accused Mr Kilonzo of misleading Kenyans on the Constitution and added: “He should differentiate between specific and general provisions of the Constitution.”

But the Justice Minister responded: “The issue raised of taxes is personal and cannot be used in these arguments since a minister cannot direct on issues of taxes,” Mr Kilonzo said.
Parliament has been recovering, on behalf of KRA, some Sh352.19 million from Mr Kilonzo’s salary since March 2010 in back taxes.
The money is related to Value Added Tax that Mutula accumulated while acting as lawyer for the National Social Security Fund, and failed to remit to KRA.
Mr Kilonzo has been asking Mr Kenyatta to quit as DPM over his ongoing case at the International Criminal Court over the post election violence since staying in office violates Chapter Six of the constitution on leadership and integrity.
However, Mr Murathe said that Article 99(3) of the Constitution does not disqualify anyone from holding office unless all avenues of appeal have been exhausted.
