High Court ruling on poll cowardly, says Koki Muli

Elections expert Koki Muli has described the High Court ruling as cowardly for failing to give Kenyans a definite date for the forthcoming general election. Speaking over the weekend at South Eastern University College in Kitui, where she is a lecturer, Muli said the court failed Kenyans who were anxious to know the exact date to go to the polls. She said by throwing the decision to President Kibaki and Prime Minister Raila Odinga, the court is abdicating its responsibility. “The court should have given a definite judgment without fear. What they have done is to create more confusion and unnecessary anxiety,” Muli said.
She said after the expiry of the coalition government in December this year, there will be a constitutional crisis between that time and the time of the next elections. “When the term of the coalition government expires in December this year and the elections are pushed to next year, who will be the caretaker government? That clearly portents a constitutional crisis,” she said.
