Kilome MP John Harun Mwau has obtained orders blocking former Ethics and Governance PS John Githongo from leading a demonstration allegedly linking him with drug trafficking.
Justice Pauline Nyamweya in her ruling also restrained Mr Githongo and eight other civil society activists from carrying out any message that is likely to interfere with the businesses of the Kilome MP.
She also ordered Mr Githongo to reveal to Mr Mwau and the court the US contacts he mentioned in writing a note titled “We the people therapy on Narcotic traffickers in Kenya.”
“In the interest of justice, fairness, the war against drug trafficking and corruption, Mr Githongo and Mr Wainaina are also ordered to file the accounts covering five years of Twaweza Ni Sisi and the International Centre for Policy and Conflict before the hearing of this petition,” ruled Justice Nyamweya.
The judge added that the activists should reveal to the court the identities of persons, security agencies, parliament and top government officials whom they claim are shielding Mr Mwau in his alleged trafficking.
According to an affidavit by the MP, Twaweza ni Sisi had planned a series of demonstrations across the country against him for the next six months.
Mr Mwau submitted that the intended actions by the lobby group are criminal; adding that his life will be threatened by the planned demonstrations and his businesses will be ground to a halt.
He told the court that a communication released by Mr Githongo showed the lobby is planning to spend up to Sh90 million in the demonstrations in Coast, Western, Central, Nairobi and Rift Valley regions.
Mr Mwau named Mr Githongo, lawyer Ndung’u Wainaina, Mr Tom Mboya, Mr Ndura Waruinge, Mr Michael Kiragu, Mr Kenneth Mungai, Mr Fred Bunde, Mr Edwin Mutuuri, Mr George Nyongesa, Twaweza ni Sisi, and the Attorney-General as respondents in the suit.
However, Mr Waruinge and Mr Kiragu distanced themselves from the planned demonstrations and accused Mr Githongo of trying to induce them to break the law by engaging in unlawful demonstrations.
The court directed Mr Mwau to serve all the respondents with the suit and the orders. The petition will be heard on February 14.
