MP Millie sued by former staff

Nominated MP Millie Odhiambo has been sued by a former member of her staff for wrongful termination. Tony Odera accuses Millie and The Cradle, a children’s organisation she founded, of wrongful termination of his services.  Odera who worked as a Project Manager with The Cradle claims Millie and trustees of the organisation terminated his employment without giving him a hearing.
Odera says he was sacked on September 6 2010 for allegedly undertaking private work during office hours without authorisation. He had been hired on a four year contract from May 2009. He argues that his termination is a breach not only of the provisions of The Employment Act of 2007, but also of his management and financial procedures manual.
According to Odera, he served Cradle dutifully and diligently until his unlawful termination. He wants the court to enter judgment against Millie, the CEO of The Cradle Eric Ogwanga, and trustees Jeffrey Maganya and Andia Adeka.  
But Millie in reponse to the suit claims that Odera had breached his terms of employment when he represented an accused person with a criminal case before a court in May 2010. The person he represented had been charged with defiling a four-year-old girl.
Millie claims that Cradle was not aware that Odera was acting for a suspect until the mother of the girl complained to the organisation.
The board of Cradle decided to give Odera a summary dismissal because his actions amounted to a conflict of interest. The court directed Odera yesterday to tabulate the amount he is seeking as compensation. The hearing will continue on July 29.
