Ruto now faces eviction after his title deed was cancelled

Eldoret North MP William Ruto faces eviction from his Eldoret house after the High Court declined to stop orders by Land minister James Orengo revoking his title deed.

Mr Ruto’s title was among 40 others cancelled by the minister on November 26, 2010.
Also revoked were the deeds for staff houses belonging to the Eldoret municipal council, Uasin Gishu Secondary School and Kipchoge Stadium.
Lady Justice Philemona Mwilu   decline to issue a stay after Mr Ruto and six others filed for a judicial review.
She also declined to hold Mr Orengo in contempt of court for revoking the titles when the case had not been determined.
Mr Ruto had filed a preliminary objection seeking to stop a case in which the Kenya Anti-Corruption Commission and Eldoret municipality sought to repossess the houses.
Mr Paul Gicheru, who represented the council, told the court that the Local Government ministry had not allocated the houses to anyone and that the council was still repaying loans from the German government and Barclays Bank which it used to buy the houses from a white settler.
He said no land had been allocated as the government had not alienated the land and council was holding it in trust for the public.
Lady Justice Mwilu ordered that the case be stood over because there were no titles to be contested as they had been cancelled.
She also suspended a fraud case facing the minister since his title had been revoked.
“Unless I am appropriately moved, this case will remain stood over generally,” said the judge.
