I am NOT Going to Court

Dear all,

Kindly, this is to dispel the strong rumour doing rounds in the Media that I am planning to go to court to challenge the results of the referendum. The Star has something to that effect in its "Corridors of Power" gossip section. The referendum was about the sovereign power of the Kenyan people, and after we voted the way we did, there is no reverse gear. We must support the new order, and the truth is I am not going to court.

I went to court before the referendum to challenge the breach of the law, and to demand a multiple-question referendum/addendum to allow Kenyans decide contentious issues as they ratified the Constitution, but the court ruled that I was time-barred. PERIOD!

Kenyans decided with clarity on August 4, 2010, and now it is implementation time. I wanted amendments during ratification, but Kenyans decided we amend later, and that is as it will be. Let's implement the new law to the minutest detail, and then those of us who want amendments will follow the clearly laid down (but clumsy?) political procedures for doing so. Constitution making is a process not an event.

I am a very strict believer in the rule of law, and once this becomes the law, I will be as vigilant as I have been, and even take Kibaki and Raila to Court if they flout this new law they fought so hard, even breaking key provisions of the current law, to ensure it passed at the referendum.

The law is not written for individuals but for all of us, equally. Hence, for a change, let's all discard our attachment to expediency and uphold the rule of law. That is what will begin our journey out of the woods. We have complained and blamed each other enough. Let's obey the law and all else will be given unto us - especially now that we have HOPE as an ally.
